a. the risk assessment shows that the limit values have been exceeded, b. all technical and organisational measures have been implemented, c. circumstances warrant exceeding the limit values, d. the special nature of the work site, work equipment or work method has been taken into account and, e. the employer can demonstrate that the employees continue to be protected against exposure to health hazards and safety risks, including ensuring that the equipment manufacturer’s instructions for safe use have been adhered to.
