Section 37. Cessation and revocation of a residence permit under sections 28 or 34

Besides revocation under section 63, refugee status and a residence permit under section 28 and 34 may also be revoked if the foreign national:
  1. a.
    has voluntarily re-availed himself or herself of the protection of the country of nationality,
  2. b.
    having lost his or her nationality, has voluntarily re-acquired it,
  3. c.
    has acquired a new nationality, and enjoys the protection of the country of his or her new nationality,
  4. d.
    has voluntarily re-established himself or herself in the country which he or she left or outside which he or she remained owing to fear of persecution,
  5. e.
    can no longer refuse to avail himself or herself of the protection of the country of nationality, because the circumstances in connection with which he or she has been recognised as a refugee under section 28 or received protection under section 34 have ceased to exist, or
  6. f.
    is not a national of any country, and because the circumstances in connection with which the foreign national has been recognised as a refugee under section 28 or received protection under section 34 have ceased to exist, is able to return to the country of former habitual residence.
A residence permit shall not be revoked under the first paragraph, (e) or (f), if the foreign national can invoke compelling reasons arising out of previous persecution for refusing to avail himself of the protection of the country of nationality or for refusing to return to the country of former habitual residence.
